A r t i c l e 43.
Information systems, information technologies and their software used by customs authorities

1. Customs operations may be performed with the use of information systems and information technologies, including those based on electronic means of communication, as well as their means of support.
2. Implementation of information systems and information technology is carried out in accordance with relevant international standards and ensure information security requirements established by the legislation states - members of the customs union.
3. Customs authorities apply information systems, information technologies and their software, developed, produced or acquired by the customs authorities in accordance with the law and (or) international treaties of the States - Members of the customs union.
4. Conditions and procedure for use for customs purposes of information systems, information technologies, their maintenance and software technical protection of information, as well as requirements for them in the organization of information exchange, based on electronic means of information exchange, determined by the customs legislation of the customs union and the law states - members customs union.
5. For purposes of cooperation between the customs authorities at the customs territory of the customs union are integrated information systems and information technology.

Information resources of customs authorities

1. Information resources of customs bodies formed on the basis of documents and information submitted to the commission of customs operations, as well as documents necessary for their commission with limited access. Procedure for the formation of information resources and access to them by the legislation states - members of the customs union.
Information resources of customs authorities means an organized set of documented information, which includes a database created, processed and accumulated in the information systems of customs authorities.
Information resources of customs authorities on customs laws and customs union, are open and accessible.
Public information resources available on the websites of customs authorities and the Customs Union Commission.
2. The procedure for obtaining owners of the information contained in the information resources with limited access under the supervision of customs authorities, determined by the laws of States - members of the customs union.

Information protection and the rights of actors involved in information processes and information

1. Information protection and the rights of actors involved in information processes and information, is carried out in accordance with the legislation of States - members of the customs union.
2. Level of information provided by means of information protection, must correspond to the category of information. Adequate level of protection of a certain category of information provided by the customs authorities, in charge of information resources.

Information exchange of customs authorities

Exchange of information between customs authorities in accordance with international agreements of the - members of the customs union.
Customs authorities shall participate in international exchange of information with customs authorities of foreign countries, as well as international and other organizations on such terms and conditions determined by the laws of the - members of the customs union.
